TN Visa Eligibility Under the USMCA
TN nonimmigrant classification allows qualified Canadian and Mexican citizens to seek temporary entry for professional-level business activities under the United States-Mexico-Canada Agreement, commonly called the USMCA. Eligibility depends on both the listed profession and the specific U.S. role. A job title alone doesn’t establish eligibility.
A prospective TN professional generally must establish:
Citizenship: The applicant is a citizen of Canada or Mexico. Permanent residents of either country aren’t eligible for TN classification.
Qualifying profession: The occupation appears on the USMCA profession list.
Professional position: The offered role requires a professional included on that list.
Prearranged employment: The applicant has a full-time or part-time position with an employer or entity in the U.S.
Required qualifications: The applicant meets the degree, license, or experience standard for the profession.
The USMCA profession list determines which occupations qualify and the credentials required for each one. Because those standards differ by profession, the offered duties must be evaluated against the applicant’s education, licensing, and documented experience.
TN Application Routes for Canadian & Mexican Citizens
The correct application route depends on citizenship, the applicant’s location, and whether the person seeks initial admission, a change of status, or an extension. The process may involve U.S. Customs and Border Protection, a U.S. embassy or consulate, or U.S. Citizenship and Immigration Services.
Canadian Applicants Canadian citizens residing outside the U.S. generally don’t need to obtain a TN visa from a consulate first. They may present their application and establish eligibility at a U.S. Customs and Border Protection-designated port of entry or an eligible pre-clearance or pre-flight inspection station.
Mexican Applicants Mexican citizens residing outside the U.S. must obtain a TN visa through a U.S. embassy or consulate in Mexico. The visa application and request for admission are distinct steps, and the documentation must support the qualifying profession and offered position.
USCIS Petitions A sponsoring employer may file a petition with U.S. Citizenship and Immigration Services for a TN professional who seeks a change of status or an extension. The appropriate option depends on the person’s current status and requested action.
Documents Supporting a TN Application
The evidence must connect the applicant, sponsoring employer, and proposed professional role. Exact documents vary by profession and application route, but the record must establish citizenship, prearranged employment, and the required qualifications.
Core supporting evidence generally addresses:
Citizenship: Documentation showing Canadian or Mexican citizenship.
U.S. employment: Documentation establishing a prearranged role with a U.S. employer or entity, including the duties and proposed employment terms.
Professional credentials: Degrees, licenses, or other records showing that the applicant satisfies the applicable USMCA standard.
Required experience: Letters from former employers when the listed profession requires experience. A resume or curriculum vitae alone is insufficient.
Work experience can’t replace a baccalaureate degree or licenciatura degree, a university credential awarded after undergraduate study, when the USMCA requires that degree for the profession. Applicants should match their evidence to the precise credential standard rather than rely on general professional history.

TN professionals may be admitted or receive extensions in increments of up to three years. There’s no statutory limit on the number of extensions, but each request must remain consistent with a temporary stay.
Applicants must maintain nonimmigrant intent, meaning they intend to enter or remain temporarily rather than treat TN classification as permanent status. The facts and documentation presented with an initial application or extension must remain consistent with that requirement.
TN professionals must work for the sponsoring employer or entity. Self-employment doesn’t qualify, including work for a corporation in which the applicant is the sole or controlling shareholder.
TD Status for Spouses & Children
A TN professional’s spouse and unmarried minor children may seek TD nonimmigrant status to accompany the principal applicant or follow later. Their eligibility depends on the TN principal maintaining qualifying status.
Family members may study while in TD status. TD status doesn’t provide automatic employment authorization and shouldn’t be treated as permission to work.
