Five Decisions That Shape a California Power of Attorney
The document should reflect whom you trust, what that person may do, and when those powers apply. Broad language isn’t automatically better. Terms that are too narrow may exclude an important transaction, while unnecessarily broad terms may give an agent more control than you intend.
Key decisions include:
- Choice of agent: You may appoint one or more people, depending on your planning goals and the terms of the document.
- Scope of authority: The authorization may cover broad categories or specific accounts, assets, transactions, and purposes.
- Effective date: The agent may be able to act immediately or only after a stated event. Powers triggered by a future event are commonly called springing powers.
- Duration: The document may end on a specified date, after a transaction, upon revocation, or under another stated condition.
- Durability: The document should state whether the agent may continue acting if you later lose legal capacity.
The California Probate Code requires certain actions to be authorized expressly. We identify powers that should be stated directly instead of relying on general language that may not cover the intended act.
Choosing an Agent & Defining the Right Scope
Consider a proposed agent’s trustworthiness, judgment, availability, potential conflicts of interest, and ability to work with financial institutions or other organizations. A close family relationship alone doesn’t make someone the right choice. The agent must also understand the responsibilities involved and be prepared to carry them out.
Before drafting, we gather information about your assets, family structure, business interests, and existing documents. Wills, trusts, beneficiary designations, ownership arrangements, and previous authorizations may need to be reviewed for consistency. That review can reveal unclear provisions, missing limitations, or powers that need to be granted expressly.
A financial power of attorney doesn’t permit an agent to make health care decisions. In California, health care instructions and appointments are generally addressed through an Advance Health Care Directive, a separate estate-planning document.
Executing, Updating, or Revoking the Document
California provides a statutory form for selected financial, real estate, tax, and other matters, but it isn’t the only option. Tailored drafting may be appropriate when you need transaction-specific powers, carefully defined limitations, multiple agents, or provisions addressing complex assets.
Execution requirements can depend on the type of document, the powers granted, and the institution expected to rely on it. The principal’s signature, acknowledgment or witnessing, delivery, and any acceptance requirements should be reviewed before use. Banks, title companies, and other organizations may also have procedures for confirming an agent’s ability to act.
A principal who has legal capacity may revoke or replace a power of attorney. However, a bank, title company, agent, or other affected party may need actual notice that the previous authorization has ended. Reviewing how the document will be delivered, stored, and later withdrawn can reduce uncertainty when circumstances change.
