Living Wills & Advance Directives in Los Angeles
Document Your Medical Wishes With One Attorney From Drafting Through Signing
A living will records instructions about medical care if illness, injury, or another condition leaves you unable to communicate. In California, these instructions are generally included in a broader advance health care directive, which can also name someone you trust to make health care decisions for you.
We help Los Angeles clients create directives that reflect their treatment preferences, personal values, and choice of decision-maker. We also consider how each directive fits with wills, trusts, powers of attorney, and other parts of an estate plan.

What a California Advance Health Care Directive Can Address
California Probate Code Section 4701 provides a statutory form that allows an adult to appoint a health care agent and provide medical instructions. The document can specify when the agent’s authority begins and place limits or conditions on that authority. You can also name an alternate agent in case your first choice is unavailable or unable to serve.
A directive can document choices concerning:
- Medical treatment: Instructions about the care you want or don’t want under specified circumstances.
- Life-sustaining measures: Preferences concerning cardiopulmonary resuscitation and artificial nutrition and hydration.
- Comfort care: Directions related to pain relief and other measures intended to provide comfort.
- Additional decisions: Instructions concerning organ donation and the selection of a primary physician.
- Agent authority: Limits or conditions governing the decisions your health care agent can make.
The scope of these instructions requires careful thought. Broad language may give an agent flexibility as circumstances change, while specific directions can provide clearer guidance about the decisions that matter most to you.
Health Care Directives & Financial Powers Serve Different Roles
An advance health care directive governs medical decisions. A financial power of attorney authorizes another person to handle the financial or legal issues described in that document. One doesn’t substitute for the other.
You may choose the same person for both roles or appoint different people based on their judgment, availability, and ability to manage each responsibility. When we prepare or review these documents together, we can identify potential gaps or conflicting provisions.
Signing, Sharing & Updating a California Directive
A California advance health care directive must satisfy applicable execution requirements to be valid. The statutory form is generally signed and dated before two qualified witnesses or acknowledged before a notary public. Additional requirements may apply in certain settings, including when the person signing is a patient in a skilled nursing facility.
Proper execution is only one part of making the document usable. Copies should be provided to the named agent and alternate agent, as well as physicians, health care providers, or institutions that may need to rely on the instructions. Keeping these people informed can reduce uncertainty about which version reflects your current wishes.
A person with the required capacity can generally revoke or replace a directive. Consider reviewing yours after a serious diagnosis, a move, a change in treatment preferences or personal values, the death or incapacity of an agent, or a significant change in a family relationship.
How Advance Directives Fit Into a Los Angeles Estate Plan
Medical, financial, and family responsibilities often overlap during incapacity. A coordinated plan may include an advance health care directive alongside a will, revocable living trust, durable power of attorney, and beneficiary designations. Guardianship, conservatorship, probate, and related family concerns may also shape the broader planning discussion.
Our process begins with a review of your goals, family structure, concerns, assets, and existing documents. This context allows us to determine how your health care instructions and chosen agents fit with the rest of your legal plan.
We assign one attorney to each estate-planning file from drafting through signing. You have a consistent point of contact while considering private medical preferences, family dynamics, and the authority given to each decision-maker. Kenneth U. Reyes is Board-Certified in family law and is a former Certified Public Accountant. His legal and financial background can help us recognize issues that may intersect with incapacity planning while we remain focused on documenting your decisions under California law.
What to Expect When Creating Your Directive
We tailor the planning process to your circumstances rather than treating the statutory form as a checklist. Before your consultation, consider your preferred agent, at least one possible alternate, any existing directive, and the medical choices or personal values you want to address.
Our estate-planning process generally includes:
- Reviewing your goals, family circumstances, assets, and existing planning documents.
- Discussing your preferred health care agent, alternate agent, treatment instructions, and any limits on authority.
- Drafting documents that coordinate with the relevant parts of your California estate plan.
- Completing a signing meeting and the applicable execution requirements.
- Recommending future review when personal, family, or health circumstances change.
